Privacy Notice – Gridiron Gastropub

This privacy notice explains how Gridiron Gastropub, our brand, collects, uses, discloses and otherwise processes your information in connection with our website, online experiences, and mobile apps when you visit our restaurant or otherwise engage with us.

 

Gridiron Gastropub is owned and controlled by HOF Village Concessions II, LLC, a Delaware limited liability company a wholly owned subsidiary of Hall of Fame Resort & Entertainment Company, a Delaware company, and its subsidiaries and affiliates (collectively “we”, “us”, or “our”) is committed to safeguarding your privacy when visiting the Gridiron Gastropub website (www.gridirongastropub.com) or through the use of our mobile applications (collectively “Services”). By visiting the website or using the mobile application, you acknowledge that the collection, use, and sharing of your information will take place as described in this Privacy Notice. The Privacy Notice does not cover practices of companies we do not own or control.

 

Note that the Hall of Fame Village website (www.hofvillage.com) has a separate privacy policy.

What Is Personal Information?

Personal information means any personally identifiable information that could be reasonably linked, directly or indirectly, to you such as your name, email address, or IP address. For example, when you place an order online, to fulfill your order, we collect personal information, such as name, address, phone number and credit or debit card information. Some laws define “personal information” differently, and we use those definitions when they are applicable.

1. Information We Obtain

Other examples of personal information collected include interactions through social media channels, traffic patterns, number of visits to certain pages, visits from other Internet sites or to third-party Internet sites linked to the websites, use of particular services and interest in services, information or features of the websites or other parties made available through or found at the websites.

2. How Do We Collect Personal Information?

The Services use cookies and web beacons when you visit our websites/apps or submit information through our submission forms, contact us, send information directly to us, or upload information to our platforms. We may also receive personal data collected by our affiliates, service providers, or other third-party providers.

We may use these automated technologies to collect information about your equipment, browsing actions, and usage patterns. Our site is not designed to respond to do not track signals or similar mechanisms from browsers. Please note that without these technologies, you may not be able to use all of the features of our site. For mobile devices, you can manage how your device and browser share certain device data by adjusting the privacy and security settings on your mobile device.

Process Transactions

Process your transactions online or in-person and to communicate with you about those transactions.

 

Marketing

Exceptions

Special circumstances - We may monitor and, when we believe in good faith that disclosure is required, disclose personal information to protect the security, property and/or assets from unauthorized use, or misuse, of our websites or mobile application.

 

We reserve the right to disclose personal information of the users of the Services: (1) for any law enforcement purpose at the request of any law enforcement body or in response to subpoena or as otherwise required by law, court or administrative agency; (2) to enforce our Terms of Service or to protect the security, quality or integrity of our websites; (3) to exercise or protect the rights, property or personal safety of our users or others.

 

Sale of assets - No part of this Privacy Notice is intended to interfere with our ability to transfer all or part of its businesses or assets, including the Services to an affiliate or independent third party at any time, for any purpose, without any limitation whatsoever. We specifically reserve the right to transfer personal information collected from the websites to the buyer of that portion of our business relating to that information. You may opt out of continued use of your information by any buyer of the Services.

 

Interest-based advertising

We may obtain information about your online activities to provide you with advertising about products and services that may be tailored to your interests. You may see our ads on other websites or apps because we use third-party ad services. The information ad services may collect includes data about your visits to our websites or apps. The data collection takes place on our websites and on third-party websites and apps that participate in these ad services. We will retain and use your information to the extent necessary to manage your relationship with us, personalize and improve your overall customer experience, and to comply with our legal obligations, resolve disputes, enforce our agreements, and as otherwise described in this Statement.

5. How We Safeguard Your Personal Information

We have implemented appropriate physical, electronic, and managerial procedures to help safeguard and secure your information. Unfortunately, no security system is 100% secure, thus, we cannot guarantee the security of the information you provide to us via the Services.

6. LInks to Other Internet Sites

The websites and mobile applications may contain links to other online services or otherwise enable you to connect with third-party websites, apps, features, plug-ins, tools, widgets and social networking services. These third-party sites operate independently, they may not follow the same privacy practices, and we are not responsible for these third parties’ information practices. We strongly encourage you to review the privacy policies and terms of the third-party providers prior to submitting any personal information to them.

7. Children and Privacy

We do not knowingly collect personal information from children in connection with our Services without the consent of a parent or guardian. If we become aware an individual under the age of 13 has provided personally identifiable information through our Services, we will immediately remove the individual’s personally identifiable information from our files. If you are using our Services on behalf of a child under the age of 13 you must either be the child’s parent or guardian or have the permission of that child’s parent or guardian, to supply the required information.

8. European Territory Visitors

In compliance with the European General Data Protection Regulation (GDPR), we provide specific additional rights for individuals who interact with us such as the right to access, rectification, right to object, to complaint, erasure and blockage (see additional detail below). In some circumstances, we may not be able to fully comply with your request, such as if it is frivolous or extremely impractical, if it jeopardizes the rights of others, or if it not required by law. In some cases, we may also need you to provide us with additional information to verify your identity and nature of the request.

 

Our Services are hosted and operated in the United States (U.S.) and if you do not reside in the U.S., laws in the U.S. may differ from the laws where you reside. By using the Services, you acknowledge that any personal data about you, regardless of whether provided by you or obtained from a third party, is being provided to us in the U.S. and will be hosted on U.S. servers, and you authorized us to transfer, store and process your information to and in the U.S.

 

Where we process your data on your consent, you have the right to revoke your consent at any time. Any data we continue to hold on this basis will be deleted. When seeking access, erasure, or rectification we may seek further information from you in relation to your request. We will endeavor to process any such requests as soon as possible. You also have the following rights:

  • The right to the erasure of your data where your personal data is no longer necessary for the purpose it was collected, where you revoke your consent to data processed solely on this basis, where you object to processing in circumstances where we rely on our legitimate interest and no compelling legitimate grounds exist to continue processing activities, your data has been unlawfully process, or reassure is required to fulfill a legal obligation.
     

  • The right to have any data we hold rectified if it is incorrect.

  • The right to apply for a restriction of the processing of your data where you dispute the correctness of the data held by us, where processing is unlawful, data is no longer required by the controller but is required by you for the exercise of defense of a legal claim, or you have raised an objection to processing where is not certain whether the legitimate grounds relied upon by the controller override your objection.

  • The right to object to the processing of your data where it is being processed by us under our legitimate interest where you have particular grounds for such objection.

  • The right to portability of your data.

 

Right to File Complaint: You have the right to file a complaint about our practices with respect to your personal data with the supervisory authority of your country or European Union member state. 9. California Privacy Rights

California consumers have a right to knowledge, access, and deletion of their personal information under the California Consumer Privacy Act. California consumers also have the right to opt out of the sale of their personal information by a business and a right not to be discriminated against for exercising their California privacy rights. We do not knowingly sell the personal information of California consumers and does not discriminate in response to privacy rights requests. We may disclose personal information to vendors that facilitate advertising and marketing through cookies or other tracking technologies through our Services.

 

We are providing notice of our privacy practices in this Privacy Notice. The Privacy Notice includes what personal information is collected, the source of the personal information, and purposes of use, as well as whether our discloses that personal information and if so, the categories of third parties to whom it is disclosed.

 

California consumers can exercise their rights directly or through an authorized agent by the means listed in the How to Contact Us section below. If we delete your personal information, we will both render certain personal information about you permanently unrecoverable and also deidentify certain personal information.

We may collect and use personal information that you submit through the Services in any manner consistent with uses in this Privacy Notice or disclosed elsewhere on the Services at the point you submit such personal information.

11. Privacy Notice Updates

We reserve the right to change this Privacy Notice from time to time. We will not reduce your rights under the Privacy Notice without your explicit consent. When you use the Services you should check the date of this Privacy Notice and review any changes since the last version.
